Federal Agencies Issue New Guidance on Offering Fertility Benefits

On Oct. 16, 2025, the U.S. Departments of Labor, Health and Human Services, and the Treasury jointly issued guidance that clarifies existing categories of excepted benefits that employers can use to offer fertility benefits, including fertility treatment through a specified disease or illness policy, or offering reimbursement for those services through an excepted benefits health reimbursement arrangement.

Health Plan Carve-outs, Surcharges and Incentives for Working Spouses

Employers may implement special rules for spouses with health coverage available through their own employers as a way to help reduce costs. These can take the form of spousal carve-outs, surcharges and incentives.
